A trademark represents your brand name.

A trademark includes any word, name, symbol, or device, or any combination used, or intended to be used, in commerce to identify and distinguish the goods of one manufacturer or seller from goods manufactured or sold by others, and to indicate the source of the goods.  In short, a trademark is a brand name.

Federal trademark registration has several benefits:

bullet Trademark registration provides constructive notice nationwide of the trademark owner's claim.
bullet Trademark registration provides evidence of ownership of the trademark.
bullet Registration of a trademark allows for the use of the federal courts to resolve legal issues.
bullet Registration can be used as a basis for obtaining registration in foreign countries.
bullet Registration may be filed with U.S. Customs Service to prevent importation of infringing foreign goods.

Use of the TM and SM symbols may be governed by local, state, or foreign laws and the laws of a pertinent jurisdiction to identify the marks that a party claims rights to. The federal registration symbol, the R enclosed within a circle, may be used once the mark is actually registered in the USPTO. Even though an application is pending, the registration symbol may not be used before the mark has actually become registered.

The federal registration symbol should only be used on goods or services that are the subject of the federal trademark registration.

Comprehensive Trademark Search ($600)

To assess whether the trademark is available, a comprehensive trademark search is highly recommended.   We search for trademarks in well-maintained databases containing trademark information for U.S. Federal, State, Common Law, Canada, and Domain Names (.com, .net, and .org).  For an additional fee, we can also look at international files (Canada, WIPO, DE, EC, and UK).

Attorney Opinion Letter ($500)

Attorney opinion letter as to the likely availability of your proposed mark for use and registration in the United States.  (Note that an attorney opinion is not a guarantee as to the ultimate validity of a trademark).

Trademark Filing ($300 + government fees)

We will file your trademark application with the United States Patent and Trademark Office and provide with this fee one "free" response to an Office Action rejecting or seeking clarification of the scope of the mark.

Premium Trademark Package ($950 + government fees)

Includes the above Comprehensive Trademark Search, Attorney Opinion Letter, and Trademark Filing (if desired).
